These Terms and Conditions ("Terms") govern your access to and use of ExpectancyIQ (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What ExpectancyIQ Is
ExpectancyIQ is a self-serve trade journaling and analytics tool. You import trade history (for example, from a CSV export) or enter trades manually, and the Service computes statistics, charts, and simulations from that data — including a Risk Simulator that projects forward using your own historical trade distribution. ExpectancyIQ does not connect live to any broker, exchange, or prop-firm account, does not execute trades, and does not hold or transmit funds. 2. Your Account
- You must provide accurate information and keep your login credentials secure.
- You must be at least 18 years old to use the Service.
- You are responsible for all activity that occurs under your account.
- One account per individual — sharing credentials or reselling access is not permitted.
3. No Investment or Financial Advice
Nothing in the Service constitutes investment, financial, tax, or legal advice, or a recommendation to buy, sell, or hold any security, contract, or instrument. Statistics, charts, and simulations reflect your own historical data only and are not predictions of future performance. You are solely responsible for your trading and financial decisions.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Reverse-engineer, scrape, or resell the Service without our written permission.
- Upload data you do not have the right to upload, or that infringes another party's rights.
- Interfere with or disrupt the integrity or performance of the Service.
5. Subscription & Billing
ExpectancyIQ is offered on an annual subscription basis only — there is no free trial and no monthly plan. Standard pricing is $144/year; an early-access price of $115.20/year may be offered to eligible new subscribers for their first year, after which the subscription renews at the then-current standard annual price. Payment is processed by Stripe at signup and your subscription automatically renews each year at the applicable price unless you cancel before the renewal date. Other than the scheduled early-access-to- standard step-up described above, if we change the standard subscription price, we will give you reasonable advance notice by email before the new price applies to your next renewal. 6. Your Data
You retain ownership of the trade data, journal entries, and other content you upload or enter into the Service ("Your Data"). You grant us a limited license to store, process, and display Your Data solely to provide and improve the Service to you. See our Privacy Policy for how we handle personal data.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any statistic, chart, or simulation is accurate or complete — accuracy depends entirely on the data you provide.
8. Limitation of Liability
To the fullest extent permitted by law, ExpectancyIQ and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or trading losses, arising from or related to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or fail to pay applicable fees. Upon termination, your right to use the Service ends, though these Terms will continue to apply to the extent relevant (e.g., limitation of liability, governing law).
10. Governing Law & Disputes
These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation; if unresolved, it will be settled by binding arbitration on an individual basis (no class actions), conducted in English. This section will be updated to name a specific governing state and venue once ExpectancyIQ operates under a registered legal entity.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms.
